Surrogacy in Mexico City

Update Oct 22 – Changes to the in Mexico City regarding surrogacy arrangements.

Surrogacy in Mexico City is increasing following the recent change in the law. I am waiting to see how it works in practice particularly, the claim that local passports are issued for surrogate born children with no visa requirement to return to the UK.

As the law in Mexico differs state to state, surrogacy agencies often have hybrid programs and base themselves in different jurisdictions. You need legal advice from a lawyer in Mexico City independent of your agency to ensure that your entire arrangement is compliant with the law. You also need to understand if you need to go through court proceedings in Mexico City for your surrogate’s legal parent status to be extinguished. You will need to show the UK High Court that you complied with the law and acted in good faith. Please read about surrogacy abroad first.

The better surrogacy agencies / clinics in Mexico City will be transparent about their surrogate recruitment policy.  The onus is on you to always ask relevant questions to make sure that exploitation does not take place.  I advise that you have private discussions with your surrogate and hire an independent interpreter where necessary.  It is essential for you to get photo ID and confirmation of marital status from your surrogate before any embryo transfer.  You should also establish communication with her.

According to UK law, the surrogate is always the legal mother regardless of the law in Mexico City.  Whether one of you is the legal parent will depend on the circumstances surrounding the insemination or embryo transfer and whether the surrogate is married or in a civil partnership.   It is essential that you get advice before you start the process.  I will advise you on whether you can become legal parent(s) to the child(ren) and how to return to England with the child(ren).  I will then provide a bespoke service for you to obtain a Parental Order.

A Parental Order extinguishes any legal rights that the surrogate and her husband have for the child(ren) according to the law in the UK.  If you do not apply for a Parental Order, you may need to consider alternatives such as adoption. I will work with you to ensure that all the necessary paperwork is in place for the Parental Order.
